To Work

To work in the Netherlands as a highly skilled migrant, you need a residence permit. Only an employer that is approved can apply for a residence permit for you. Read what the conditions are and how the employer applies for the residence permit.

Who can submit this application?

You can only apply for this if you are a recognized sponsor or if you are authorized by the recognized sponsor.

It concerns an application for the following procedure:

  • TEV procedure: the highly skilled migrant is still abroad and is subject to an mvv.
  • VVR procedure: the highly skilled migrant is not subject to an mvv and resides in the Netherlands or abroad.
  • Extension of the period of validity of the residence permit.
  • Changing the residence permit (together with extending the period of validity of the residence permit): the foreign national already has a residence permit and wants to change his residence permit to the purpose of residence of 'highly skilled migrant'

Please ensure that this request is received by the VSD immigration on time. Therefore, submit the application before the validity of the highly skilled migrant's current residence permit expires. Pay attention! Avoid submitting the application later than 4 weeks after the expiry of the residence permit. This is important to prevent the highly skilled migrant from getting a residence gap. A residence gap is an interruption in the residence. This may have consequences for any follow-up procedures, such as an application for a permanent residence permit or an application for naturalisation. Do not submit an application for an extension if the residence permit is still valid for more than 3 months. 

Intra-company transfer:

Are you submitting an application for the purpose of residence of 'work as a highly skilled migrant', but does the highly skilled migrant fall within the scope of the Intra Corporate Transferees Directive 2014/66/EU? VSD immigration will check the application against the conditions of the guideline. If the highly skilled migrant meets these conditions, he will automatically receive a residence permit for the purpose of residence 'Transfer within a company'. If the employee falls within the scope of the ICT Directive, but does not meet all the conditions of the Directive, he cannot still obtain a residence permit for the purpose of residence 'work as a highly skilled migrant'. Nationals of Japan, the United States of America or Turkey, who fall within the scope of the ICT Directive, but who can rely on a trade treaty or standstill provision, may be eligible for the residence permit 'work as a highly skilled migrant'.

Have official foreign documents legalized and translated into Dutch, English, French or German.

Additional documents in case of marriage or registered partnership

  • Marriage certificate or certificate of registered partnership.

Extra documents for unmarried partner

 


Additional documents for minor children

  • Declaration of consent with a copy of the ID of the parent left behind.
  • Documents proving legal authority.
